Agreement for Vehicle Hire
This document outlines the legally binding terms and conditions between:
(1) Kroovel Ltd Company Number: 16357730 (“We”, “Us”, “Our”)
and
(2) The Hirer (“You”, “Your”, “the Customer”)
1. Definitions
- Agreement: The contract for hire governed by these terms and conditions, which you accept upon confirming your booking.
- Booking: Your formal request to hire a vehicle from us based on the details you provide and for which a payment is made.
- Company: Refers to Kroovel Ltd.
- Customer: The individual or entity booking the service, including any members of their party.
- Deposit: The non-refundable initial payment required to secure your Booking.
- Hire: The act of hiring a vehicle and driver for the agreed period.
- Operator: The third-party company that provides the vehicle and driver for the Hire.
- Balance: The remaining amount of the total hire cost, payable after the Deposit has been made.
- Total Cost: The full price for the Hire as quoted at the time of booking.
2. Booking and Payments
2.1. Deposit To confirm your Booking, a Deposit is required. Payment of the Deposit signifies your full acceptance of this Agreement and its terms. Your booking is not secured until the Deposit is received by us. All Deposits are non-refundable.
2.2. Balance Payment The remaining Balance is to be paid directly to the Operator on or before the date of the Hire. The Operator reserves the right to cancel the Hire if the Balance is not paid upon request. The Operator may contact you before the hire date to arrange for payment of the Balance and may terminate the booking if payment is refused.
3. The Hire
3.1. Accuracy of Information The price we quote is based on the information you provide. If the details of the Hire change (e.g., additional passengers, different locations, extended time), we or the Operator are entitled to adjust the Total Cost. We reserve the right to amend the charges or cancel the booking if the information you provide is found to be incorrect or misleading. If your party’s actions cause significant delays that impact the Operator’s subsequent bookings, you may be charged for the associated losses.
3.2. Booking Confirmation We will provide a written confirmation detailing your Booking. It is your responsibility to review this and notify us of any errors immediately.
3.3. Changes to Your Booking You may request amendments to your Booking up to seven (7) days prior to the Hire date. All amendments are subject to vehicle availability and may incur an administration fee to cover new documentation. If your requested changes lead to a cancellation of the original Agreement, the cancellation terms in section 3.5 will apply.
3.4. Vehicle Availability In the rare event that the vehicle you booked is unavailable due to mechanical failure or other unforeseen circumstances, we and the Operator will strive to provide a suitable replacement of equal or greater value. We cannot guarantee specific colours or interior features of the replacement vehicle. We will make every effort to inform you of such a change, but we are not liable for any disappointment or loss resulting from this necessary substitution.
3.5. Cancellation by You If you cancel your booking, your Deposit will be forfeited.
- All cancellations must be submitted in writing via post or email. We do not accept verbal cancellations.
- Depending on the notice period provided, a cancellation charge of up to £150 may be applied at the Operator’s discretion.
- By accepting these terms, you authorise us to share your personal and payment details with the Operator for the purpose of collecting any applicable cancellation fees. If the Operator seeks to recover the full hire cost, they will provide you with written notice. If you do not dispute this charge within seven (7) days, you authorise the Operator to charge the full amount to the card details on file.
3.6. Termination by Us We or the Operator reserve the right to terminate this Agreement at any time if we have reason to believe the Hire is for any illegal purpose or that payments are being made through fraudulent or dishonest means.
4. Liability and Responsibilities
4.1. Your Responsibilities During the Hire, you are responsible for the conduct of all members of your party. You agree that no one in your party will:
- Engage in any illegal, disruptive, or threatening behaviour.
- Cause damage to the vehicle.
- Smoke inside the vehicle. The Operator’s driver has the right to terminate the Hire immediately and eject any passengers who violate these rules, with no refund provided. You will be held financially responsible for the full cost of any repairs required due to damage caused by you or your party.
4.2. Our Limitation of Liability Kroovel Ltd acts as a booking agent. The responsibility for providing a safe, roadworthy vehicle with a qualified driver rests with the Operator. We conduct due diligence to ensure all our Operators have valid motor and public liability insurance.
- We are not liable for any financial loss, personal injury, or damage caused by the actions or omissions of the Operator.
- Neither Kroovel Ltd nor the Operator shall be held liable for delays or cancellations resulting from circumstances beyond our control. This includes, but is not limited to, traffic accidents, road closures, severe weather, civil unrest, or acts of terrorism.
4.3. Recommended Insurance If the Hire is for a critical event, such as a wedding or airport transfer, we strongly advise you to secure your own comprehensive travel or event insurance.
5. Complaints and Legal
5.1. Complaints Procedure In the unlikely event of a problem or complaint, you agree to direct your concerns in writing to the Operator. The Operator will investigate and provide a response within 21 days. Kroovel Ltd is not responsible for resolving complaints or providing compensation; any such claims must be made directly against the Operator.
5.2. Consumer Rights These terms and conditions do not override or affect your statutory rights as a consumer.
5.3. Jurisdiction This Agreement is governed by the laws of England and Wales, and any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
